Terms & Conditions for Icarus Composites

1. Introduction
These Terms & Conditions govern your use of the website www.icaruscomposites.co.uk (hereafter referred to as “the Website”) and the products and services provided by Icarus Composites, a trading division of Icarus Group Ltd (referred to as 'we', 'us', or 'our'). By accessing or using the Website, you agree to these Terms & Conditions.
2. Definitions
- 'Customer' refers to any individual or entity purchasing products or services from Icarus Composites.
- 'Products' refer to the advanced composite materials supplied for pipe, tank, and structure repairs.
- 'Services' refer to training and repair applications provided by Icarus Composites.
3. Orders and Payment Terms
- All payments must be made within 30 days from the date of invoice.
- Acceptable payment methods are BACS and online payments.
- We reserve the right to withhold any deliveries or suspend services if paymentterms are not met.
4. Delivery and Returns
- Notice must be given to us of any goods not received within 20 days from the dispatch date stated on the invoice.
- Any shortage or damage must be notified within 48 hours of receipt of goods.
- Complaints will only be accepted if made in writing via email within 14 days of receipt of goods.
- No goods may be returned without priorauthorization from Icarus Composites.
5. Liability and Warranty
- We do not accept liability for any damage, misuse, or improper application of the products by customers.
- Repairs are only guaranteed when applied by qualified personnel who have been trainedby us and assessed as competent.
- All repairs must comply with ISO 24817 or ASME PCC-2 standards and must undergo quality assurance tests by the lead technician.
- Icarus Composites disclaims any liability for repairs made by unqualified personnel.
6. Data Protection and Privacy
- We collect the necessary personal data to process your order, including your name, contact details, and payment information.
- We adhere to UK GDPR and the Data Protection Act 2018 in handling your data. Please refer to our Data Protection Policy for further details.
- Your personal data will be retained as specified in our Data Retention Policy.
7. Intellectual Property
- All brands, trademarks, intellectual property, and website content, including text,images, and product descriptions, are solely the property of Icarus Group Ltd.
- You may not use, reproduce, or distribute any of the website content without express written permission from us.
8. Website Usage
- You are prohibited from engaging in activities that compromise the security or functionality of the Website, including but not limited to hacking, spamming,or using any harmful code.
- We reserve the right to restrict or terminate access to the Website for users who violate these terms.
9. Governing Law and Dispute Resolution
- These Terms & Conditions are governed by the laws of the United Kingdom.
- Any disputes arising under these terms shall first be resolved through good faith negotiations between the parties.
- If the parties are unable to resolve the dispute within 30 days, the matter shall be referred to mediation in accordance with the rules of the International Chamber of Commerce (ICC).
- If mediation fails, the dispute shall be settled by arbitration in accordance withthe ICC rules, and the decision of the arbitrator shall be final and binding.
